1. About these terms
These terms apply to your use of this website, operated by Flo Studio Software (ABN 91 670 683 495) (“we”, “us”, “our”), based in Victoria, Australia. By using the website you agree to these terms. If you do not agree, please do not use it.
2. General information only
The content on this website, including articles, descriptions of services and examples, is general information about our business and the kind of work we do. It is not professional, technical, legal or financial advice and should not be relied on as such. Viewing this website, or sending us an enquiry, does not create a client relationship or a contract for services.
Our services are supplied only under a written proposal, statement of work or services agreement signed or accepted by both parties. If those documents conflict with these terms, they prevail for the services.
3. Using this website
You must use the website lawfully and respectfully. You must not:
- use the website in a way that breaks the law or the rights of others;
- copy, scrape, harvest or systematically collect content or data from the website, whether by automated tools or by hand, without our written permission;
- try to gain unauthorised access to the website, our systems or other people’s information, or probe, scan or test their security;
- introduce malware, send spam, or interfere with or overload the website or its infrastructure;
- use our name, logo or content to suggest a relationship with us that does not exist, or to mislead others.
We may suspend or block access to anyone who breaks these terms.
4. Intellectual property
All content on this website, including text, graphics, logos, images, illustrations, layout, design and code, is owned by or licensed to Flo Studio Software and is protected by copyright and other intellectual property laws, including the Copyright Act 1968 (Cth). Flo Studio Software® and the Flo Studio Software logo are our trade marks. Other names and marks on this website belong to their owners.
You may view the website, and print or save a copy of individual pages for your own personal or internal business use, if you keep all copyright and trade mark notices. You may link to the website’s pages. Any other use, including copying, reproducing, modifying, republishing, distributing or creating derivative works, needs our prior written permission.
Nothing on this website transfers any intellectual property to you. Ownership of work we create for clients is dealt with in the relevant services agreement.
5. What you send us
When you send us an enquiry, application or message, you promise that the information is accurate and that you are entitled to share it. You give us permission to use it to respond to you and for the purposes in our Privacy Policy.
Please do not send us confidential or commercially sensitive information, or personal information about other people, through the website. We will happily sign a confidentiality agreement before you share detail about your project. Unless we have agreed otherwise in writing, we do not treat unsolicited information as confidential.
6. Links and third-party services
The website may link to or use third-party websites and services (for example Cloudflare Turnstile). We do not control them, do not endorse them and are not responsible for their content, availability or practices. Your use of them is at your own risk and under their own terms.
7. Disclaimer
We aim to keep the website accurate, secure and available, but it is provided “as is” and “as available”. To the maximum extent permitted by law, we make no promise that the content is complete, current or error-free, or that the website will be uninterrupted, free of viruses or suitable for your purposes. Content may be changed or removed at any time without notice.
8. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law, and which cannot lawfully be excluded, restricted or modified.
9. Limitation of liability
To the maximum extent permitted by law:
- we exclude all liability to you for any loss or damage arising from or in connection with your use of, or inability to use, this website or its content, whether in contract, tort (including negligence), under statute or otherwise;
- we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, data or goodwill; and
- where a law implies a condition, guarantee or warranty that cannot be excluded, our liability for breaching it is limited, where the law permits, to resupplying the services or paying the cost of having them resupplied, or to replacing or repairing the goods or paying the cost of doing so.
Our liability is reduced to the extent that you or anyone else caused or contributed to the loss. Where the proportionate liability provisions of the Wrongs Act 1958 (Vic) or similar laws apply, they apply to the maximum extent permitted.
These limits apply to this website only. The liability that applies to our services is set out in the services agreement.
10. Privacy and cookies
How we handle personal information is explained in our Privacy Policy, and how we use browser storage is explained in our Cookie Policy.
11. Changes to the website and these terms
We may change the website at any time, and we may update these terms from time to time. The current version is always on this page, with the date it was last updated at the top. By continuing to use the website after a change, you accept the updated terms.
12. Governing law and disputes
These terms and your use of this website are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth courts that sit in Victoria. If you have a concern about the website, please contact us first through our Contact page so we can try to resolve it.
13. General
If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, that does not mean we have given it up. You may not transfer your rights under these terms to anyone else. These terms, together with our Privacy Policy and Cookie Policy, are the whole agreement between you and us about use of this website.
